1. Who we are

DEUSPIXEL is an online shop selling printable wall art as digital downloads. It is operated as a registered Croatian craft business.

In these terms, we, us and our mean DEUSPIXEL. You means the person placing the order.

2. These terms and how they apply

These terms apply to every order placed through deuspixel.com. By completing an order you confirm that you accept them.

2.1 Forming a contract

Placing an order is an offer to buy. A contract between us is formed when we confirm your order by email. If we cannot accept your order we will tell you and refund any payment in full.

2.2 Who may buy

You must be at least 18 years old and legally able to enter into a contract.

2.3 Where we sell

We sell only to the countries listed at checkout. If your country is not listed, you will not be able to complete an order. This is a deliberate commercial decision and not a comment on you or your country.

2.4 Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published on this page at the moment you place it. Changes are never applied retrospectively to an order already made.

3. What you are buying

Every product in this shop is a digital file. You are buying artwork you download and print yourself, or have printed by a print shop of your choosing.

3.1 What you receive

• One PDF file, delivered to you after payment
• Inside that PDF, a private link to your high resolution artwork files
• Artwork supplied as JPEG at 300 DPI
• Five print ratios of the same design, covering more than twenty standard frame sizes
• A printing guide inside the same PDF

3.2 What you do not receive

• A printed poster or any physical item
• A frame, mount or any hanging hardware
• Anything delivered by post or courier

3.3 How designs appear on screen

Product images are shown as accurately as we can manage, but colours vary between screens, and a printed result depends on your printer, ink and paper. Small differences between what you see on screen and what comes out of a printer are normal and are not a fault in the file.

4. Your licence, what you may and may not do

When you buy a design you receive a personal use licence. You do not buy the copyright, and ownership of the artwork stays with us at all times.

The licence is worldwide, non exclusive, non transferable, and lasts indefinitely unless you break these terms.

4.1 You may

• Print the design as many times as you like for your own home
• Print it at any of the sizes included in your purchase
• Have it printed by a commercial print shop or online printing service on your behalf
• Frame it, mount it, and hang it anywhere in your own home
• Print a copy as a personal gift for a friend or family member
• Keep the files and print them again in the future at no extra cost

4.2 You may not

• Resell, share, give away, sublicense or redistribute the files themselves
• Sell printed copies of the design, in a shop, at a market, on Etsy or anywhere else
• Use the design in any commercial or public space, including a cafe, salon, office, clinic, shop, hotel or rental property
• Use the design in advertising, packaging, merchandise or any product for sale
• Share your private download link publicly or with anyone else
• Upload the files to any website, marketplace, cloud folder or file sharing service that others can access
• Claim the design as your own work
• Use the files to train, fine tune or develop any artificial intelligence or machine learning system
• Alter the design and then present or distribute the result as an original work

4.3 If the licence is broken

If you use a design outside this licence, the licence ends immediately, and we may take steps to protect our copyright. No refund is due in that situation.

5. Personalised name art

Some products are personalised with a name or wording you supply. These are made individually for you and are treated differently from ready made designs.

5.1 You are responsible for the spelling

We set the name exactly as you type it at checkout. Please check it carefully before you pay.

5.2 If you spot a mistake early

If you contact us before we send your file and ask for a correction, we will make it at no charge. Because these orders are usually completed within 12 to 24 hours, tell us as soon as you can.

5.3 Delivery time

Personalised orders are prepared by a person, not automatically. They are normally delivered within 12 to 24 hours. At busy times this can take a little longer, and we will tell you if it will.

5.4 What we will not set

We may decline to produce personalised wording that is unlawful, offensive, hateful, or that infringes somebody else’s trade mark or copyright. If we decline, we will refund you in full.

6. Prices and payment

6.1 Currency and taxes

All prices are shown in US dollars and are the final amount you pay. No tax is added at checkout.

DEUSPIXEL is not registered for VAT. No VAT is charged, under Article 90, paragraphs 1 and 2 of the Croatian VAT Act, Zakon o porezu na dodanu vrijednost.

If you pay in another currency, your bank or card issuer converts at its own rate and may add its own fee. That is between you and them, and we have no control over it or visibility of it.

6.2 Bundle discounts

Quantity discounts are applied automatically in the cart, based on the number of items in your order. The discount tiers are shown on the shop pages. Discounts apply to the number of items, not to how many copies of one design you buy.

6.3 Payment

Payment is taken at checkout by card or by PayPal, through an encrypted payment provider. We never see or store your full card details.

6.4 Pricing errors

We take care with prices, but if a product is listed at an obviously incorrect price and the error is one you could reasonably have spotted, we may cancel the order and refund you rather than supply at that price.

7. Delivery of your files

7.1 Ready made designs

Your download becomes available as soon as your payment clears. The link appears on the order confirmation screen and is emailed to you.

7.2 Personalised designs

These are delivered within 12 to 24 hours, as described in section 5.

7.3 Keep your PDF

Your download link does not expire, so keep the PDF somewhere safe. If you lose it, contact us with your order number and we will resend it.

7.4 Downloading on a computer

We recommend downloading on a laptop or desktop. Some mobile PDF readers block the link inside the file, and phones often save large files somewhere difficult to find. This is a limitation of those apps, not a fault in your order, but we will always help you get your files.

7.5 If your email does not arrive

Check your spam or junk folder first. If it is not there, contact us and we will resend it.

8. Printing is your responsibility

You choose where to print, what paper to use and what size to print at. We supply the file, and the quality of the finished print depends on decisions made after the file leaves us.

• Print at 100 percent scale, and turn off any fit to page or shrink to fit option
• Choose the ratio that matches your frame, all five are included
• Matte paper at 200 to 250 gsm is our general recommendation

If a print comes out cropped, stretched or the wrong size, it is almost always a scaling setting rather than the file. Contact us and we will help you work out which file and which setting you need.

Any recommendation we make about printers, paper or printing services is given in good faith to be helpful. We are not paid by any printing service we mention, and we are not responsible for the quality, price, delivery or conduct of a third party printer you choose to use.

9. Cancellation and refunds

9.1 Before your download is available

If you have paid but your files have not yet been made available to you, contact us straight away and we will cancel and refund the order in full.

9.2 After your download is available

Digital files cannot be returned. Once your download has been made available, we do not offer refunds for change of mind. At checkout you are asked to confirm that you want immediate access and that you understand this.

This does not apply where the product is faulty or not as described. See 9.3.

9.3 If something is wrong with your order

We will put it right. Contact us and we will repair, replace or refund, depending on what is wrong. This covers situations such as:

• A file that is corrupt or will not open
• A file that does not match its description on the product page
• A missing ratio or a missing file from your download
• A mistake we made on a personalised design
• A download link that does not work and cannot be made to work

Tell us within a reasonable time of noticing the problem, give us your order number, and describe what went wrong. If you can, send a screenshot. That usually lets us solve it in one reply.

9.4 What is not a fault

• You changed your mind after downloading
• You bought the wrong design by mistake
• Your printer, paper or print shop produced a poor result
• The colour on your screen differs from the colour on paper
• You supplied the wrong spelling for a personalised design

Even where something is not strictly a fault, please still ask. We would rather help you get a good result than win an argument about whose fault it was.

9.5 How refunds are paid

Refunds are made to the original payment method, normally within 14 days of us agreeing to the refund. When a refund is issued, the licence in section 4 ends and you must stop using and delete the files.

10. Your consumer rights

Nothing in these terms limits or excludes any right the law of your own country gives you as a consumer and does not permit us to exclude. Where these terms and those rights conflict, those rights win.

10.1 Customers in Australia

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

10.2 Customers in New Zealand

Where you buy as a consumer, the Consumer Guarantees Act 1993 applies and nothing in these terms limits it.

10.3 Customers elsewhere

Consumer protection rules in your own country continue to apply to you, whatever these terms say.

11. Availability and changes to the shop

We may add designs, change prices, or withdraw a design from sale at any time. Withdrawing a design does not affect a licence you already hold for it, and you may keep using the files you have already bought.

We aim to keep the site available at all times but cannot guarantee it. Access may be interrupted for maintenance, updates, or reasons outside our control.

12. Intellectual property

All designs, images, text, layout and code on this site are owned by DEUSPIXEL or used with permission, and are protected by copyright.

Buying a design gives you the licence described in section 4. It does not transfer copyright or any other intellectual property right to you.

If you believe anything on this site infringes your rights, contact us with the details and we will investigate promptly.

13. Our liability to you

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

We are not responsible for loss or damage that is not foreseeable, or for any of the following:

• The cost or quality of printing carried out by you or by a third party
• Paper, ink, framing or any other materials you buy
• Loss of the files after delivery, for example a lost PDF or a deleted download
• Any use of a design outside the licence in section 4

Where we are liable, our total liability for any order is limited to the amount you paid for that order.

14. Your data

We collect only what we need to process your order and answer your messages. How we handle it, how long we keep it and what rights you have are set out in our Privacy Policy.

Please note that we are required by Croatian law to keep invoice records for eleven years, so completed order records are retained for that period even if you ask us to delete other data.

15. Complaints and disputes

If something has gone wrong, tell us first. Most problems are solved in a single message, and we would always rather fix it than argue about it.

Send your complaint using the contact details in section 18, including your order number and what you would like us to do. We will acknowledge it within one working day and give you a substantive answer as quickly as we can.

If we cannot resolve it between us, you may be able to take the matter to a consumer body or court in your own country. Section 10 explains that these terms do not remove those rights.

16. Governing law

These terms and any contract made under them are governed by the law of the Republic of Croatia, and the courts of Croatia have jurisdiction.

If you are buying as a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may also be able to bring proceedings in your own country.

17. General

Severability. If any part of these terms is found to be unenforceable, the rest continues to apply.

No waiver. If we do not enforce a term straight away, we do not lose the right to enforce it later.

Transfer. You may not transfer your licence or your rights under these terms to anyone else. We may transfer our rights and obligations to another business, and if we do, it will not affect your rights.

Events outside our control. We are not liable for failing to perform where the cause is outside our reasonable control, but we will tell you and, if the delay is substantial, you may cancel and be refunded.

Whole agreement. These terms, together with your order confirmation and our Privacy Policy, form the whole agreement between us.

Language. These terms are written in English and English is the language of the contract.
